1. Identity of the Entrepreneur

2. Applicability
These terms and conditions apply to every offer from the entrepreneur and every distance contract concluded between the entrepreneur and the consumer. Before the distance contract is concluded, the text of these terms and conditions is made available to the consumer. By placing an order, the consumer confirms that they have read and accepted these terms and conditions.
3. The Offer
If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated. The offer contains a complete and accurate description of the products offered. All prices indicated are including VAT. Obvious errors or mistakes in the offer do not bind the entrepreneur.
4. The Agreement
The agreement is concluded at the moment of acceptance by the consumer of the offer and the fulfilment of the corresponding conditions. If the consumer has accepted the offer electronically, the entrepreneur will promptly confirm receipt of acceptance by electronic means.
5. Right of Withdrawal
Upon delivery of products, the consumer has the right to dissolve the contract without giving reasons within 14 days (the Reflection Period). The Reflection Period commences on the day the consumer, or a third party designated by the consumer (other than the carrier), receives the product. The withdrawal request must be submitted in writing by means of a clear statement identifying the order and the product(s) concerned.

Exceptions — the right of withdrawal does not apply to:
• Products manufactured to the consumer's specifications or clearly personalised (e.g., custom engravings, monogramming, made-to-order pieces);
• Earrings, piercings, body jewellery, and other products intended for direct body contact where return is unsuitable for hygiene or health reasons once unsealed, worn, or tried on;
• Sealed goods that are not suitable for return for hygiene or health-protection reasons once unsealed.

The entrepreneur may ask the consumer about their reason for withdrawal; the consumer is not obliged to state a reason. The consumer must return the product within 14 calendar days of notifying the entrepreneur of the withdrawal.
6. Obligations during the Reflection Period
During the reflection period, the consumer must handle the product and its packaging with due care. The consumer may only unpack or use the product to the extent necessary to establish its nature, characteristics, and functioning — equivalent to how one would inspect an item in a physical store.

If the consumer has handled the product beyond what is necessary for inspection, including by wearing, trying on, or exposing the jewellery to skin contact, cosmetics, perfume, moisture, fingerprints, skin oils, scratches, deformation, or other traces of use, the entrepreneur is entitled to hold the consumer liable for any resulting diminished value. Missing original boxes, certificates, branded packaging, gift packaging, tags, or other authentication or presentation materials may also result in a deduction.

Where the condition of the returned product means that it can no longer be sold as new, the depreciation deduction may amount to up to 100% of the original sale value.
7. Refund Policy
If the consumer exercises their right of withdrawal, the product purchase price and the original standard outbound delivery cost will be refunded within 14 days of the entrepreneur receiving the returned product and completing a reasonable inspection of the return. If the consumer selected an express or premium delivery option, only the cost equivalent to the standard delivery method will be reimbursed; any additional outbound delivery costs are non-refundable.

Return shipping is entirely at the consumer's expense. Because Mylasa Jewellery ships all products under carrier insurance, the consumer is required to ensure the product is returned safely. The cost of return shipment, including any insurance costs, shall be borne exclusively by the consumer and will not be reimbursed by the entrepreneur. Insured return shipment corresponding to the value of the product is strongly recommended. If the consumer returns the product without adequate insurance, all transit risk remains with the consumer. The consumer bears full responsibility — including financial liability — for any loss, theft, or damage to the product during return transit. The entrepreneur accepts no liability for returns that are lost or damaged in transit.

Returns must be sent to the address provided by our customer service team upon submission of the withdrawal request. Products must be returned in their original packaging, unworn, and in undamaged condition. The entrepreneur reserves the right to deduct from the refund any depreciation in value resulting from handling beyond what is necessary for inspection.
8. Prices
The prices stated in the offer of products or services include VAT. Prices are subject to change, but changes will not affect orders already confirmed. In the event of an obvious pricing error arising from a technical issue, third-party data source error, system malfunction, human error, or other manifest mistake, the entrepreneur reserves the right to cancel the order and issue a full refund.
9. Complaints Procedure
Complaints about the implementation of the agreement must be submitted fully and clearly described to the entrepreneur within a reasonable time after the consumer has discovered the defects, and in any event within 2 months of discovery. The consumer must provide all information and supporting evidence reasonably required to assess the complaint. Incomplete complaints or complaints submitted without sufficient supporting documentation may not be processed until the requested information is provided. The entrepreneur will respond within 14 days of receipt. If a complaint cannot be resolved by mutual agreement, the consumer may use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
10. Limitation of Liability
To the fullest extent permitted by applicable law, the entrepreneur's total liability to the consumer in connection with any claim arising from the agreement shall not exceed the total amount paid by the consumer for the product giving rise to the claim.

The entrepreneur is not liable for indirect, incidental, consequential, punitive, emotional, reputational, business, or data-related losses, including but not limited to loss of profits, loss of data, loss of opportunity, or loss of business. The entrepreneur is also not liable for allergic reactions, skin irritation, or other product-use sensitivities unless caused by a proven manufacturing defect and to the extent such liability cannot be excluded by law.

Nothing in these terms excludes or limits liability for death or personal injury caused by the entrepreneur's negligence, fraud, or any other liability that cannot be lawfully limited or excluded.
11. Intellectual Property
All content on this website — including but not limited to text, images, logos, product designs, and branding — is the intellectual property of Mylasa Jewellery and is protected under applicable copyright and trademark law. No part of this website or its content may be reproduced, distributed, or used commercially without the prior written consent of Mylasa Jewellery.
12. Force Majeure
The entrepreneur shall not be liable for any failure or delay in the performance of obligations under this agreement to the extent caused by events beyond the entrepreneur's reasonable control, including but not limited to natural disasters, war, civil unrest, government actions, strikes, pandemics, supply chain disruptions, or failures of third-party service providers. The entrepreneur will notify the consumer as soon as reasonably practicable and endeavour to minimise any impact on the consumer.
13. Governing Law & Dispute Resolution
These terms and conditions are governed by the laws of the Netherlands. Any disputes arising out of or in connection with these terms or any agreement concluded under them shall be submitted to the competent court in the Netherlands, unless mandatory consumer protection law applicable in the consumer's country of residence requires otherwise.

In the event of a dispute, the consumer may also submit a complaint via the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
14. Privacy & Data Protection
Mylasa Jewellery processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable national privacy legislation. Personal data provided by the consumer will only be used to fulfil the agreement and to provide related services. For full details, please refer to our Privacy Policy.
15. Defective or Damaged Product Claims
The consumer is expected to inspect the product immediately upon delivery. Any claim that a product was damaged in transit should be reported to the entrepreneur in writing within a reasonable time after delivery, with 48 hours after delivery being the recommended period, and must be accompanied by clear, timestamped photographic evidence sufficient to assess the condition of the product at delivery. If notice is delayed or adequate evidence is not provided, it may be presumed that the damage occurred after delivery or while the product was under the consumer's control, unless the consumer demonstrates otherwise.

Mylasa Jewellery documents and photographs all products prior to dispatch. This pre-shipment record serves as evidence of the product's condition at the time of handover to the carrier.

Upon receipt of a returned product, the entrepreneur reserves the right to conduct a thorough inspection — including, where necessary, an independent professional assessment — to determine whether the reported defect constitutes a genuine manufacturing or transport fault, or whether the damage was caused by the consumer (including deliberate damage, misuse, negligence, or improper storage). The costs of such assessment may be charged to the consumer where the claim proves unfounded or fraudulent.

If the inspection determines that the damage was caused by the consumer — whether intentionally or through misuse — the entrepreneur reserves the right to:
• Reject the refund or replacement claim in full;
• Return the product to the consumer at the consumer's expense;
• Recover the costs of the independent inspection from the consumer;
• Pursue legal proceedings to recover all losses sustained as a result of the fraudulent claim.

Submitting a false or fraudulent product defect claim constitutes a criminal offence under applicable law. The entrepreneur reserves the right to report such cases to the relevant authorities and to seek full compensation for all losses, including legal costs.
